Charges escalate for Ndimande brothers in high-profile AKA murder case

The Ndimande brothers, Malusi Dave and Siyabonga Gezane, accused of the murder of rapper Kiernan ‘AKA’ Forbes and his friend Chef Tebello ‘Tibz’ Motsoane, were served with multiple indictments at the Durban Magistrate's Court on Thursday morning.

This action prepares them for their first combined appearance with their five co-accused—Lindokuhle Thabani Mkhwanazi, Lindani Zenzele Ndimande, Siyanda Eddie Myeza, Mziwethemba Harvey Gwabeni, and Lindokuhle Mhlaliseni Mkhwanazi—at the Durban High Court on June 19 for a pre-trial conference. 

Senior State prosecutor Elvis Gcweka confirmed the consolidation, stating: “They (the brothers) will be consolidated with the others on this day. Already, this case number is included with the others.”

The State took action on Monday at the Durban High Court to combine Myeza's 2022 case, in which he is accused of killing a taxi owner, with the murder cases of AKA and Tibz. This follows ballistic evidence that connects spent cartridges from the 2022 killings to the firearm used to kill Motsoane.

Consequently, Myeza's 2022 murder charges have been incorporated into the amended indictment for the AKA and Tibz murders, which was served on the Ndimande brothers on Thursday.

After receiving the AKA matter indictment, the Ndimande brothers were served with a second indictment for an unrelated, extensive case involving four murders, two attempted murders, conspiracy to commit murder, and firearms charges.

The brothers face charges alongside Lindokuhle Mkhwanazi and Philani Innocent Sikhosana for the alleged premeditated murder of taxi owner William Kunene on November 9, 2022.

The State alleges they conspired to kill Kunene, monitored him, and shot him in the parking area at Seadoone Mall in Doonside after a Checkers shopping trip. Kunene was a member of the Folweni, Adams, and Stanger Taxi Associations.

Dave Ndimande was escorted out, while his brother Siyabonga remained in the dock to be served a third indictment for a separate case.

He faces charges of robbery with aggravating circumstances, kidnapping, conspiracy to commit murder, murder, attempted murder, and firearms alongside Myeza, Siphamandla Ngcobo, Lindani Zenzele Ndimane, and Mduduzi Comfort Ngubeni.

The State alleges Siyabonga participated in the robbery and kidnapping of Sizwe Goodman Ndlovu on January 7, 2023, at North Beach, forcefully removing him and seizing his Mercedes-Benz.

Furthermore, the indictment alleges that on March 6, 2023, Siyabonga acted with common purpose in the murder of Nhlanhla Ngcobo and attempted murder of Zamokuhle Mkhwanazi-Ngcobo at Botanic Gardens Road in Berea, where multiple shots were fired at their Land Rover.

Magistrate Ashwin Singh confirmed the transfer of all matters, stating: “This matter is transferred to the high court where you will appear on 19 June, the State may join charges with the other accused as well on that day.”
